ODPC Registration: Controllers & Processors in Kenya

Identify controller and processor roles, assess ODPC registration requirements and prepare a coherent application in Kenya.

Map the role before choosing the registration

A controller determines why and how personal data is processed. A processor handles personal data on a controller's behalf. An organisation can have different roles for different activities, so the choice should follow its operations rather than the label used in a service contract.

For example, a business may make its own decisions about staff data while providing a processing service to customers. List the activities, data subjects, categories of information, purposes and organisations involved. That map helps identify whether more than one registration role needs to be considered.

Check the exemption and mandatory categories

Do not assume a small business is automatically exempt. ODPC's guidance distinguishes size-related thresholds from activities and sectors that require registration irrespective of turnover or staff numbers. Property management, financial services and direct marketing are examples listed in the guidance.

Use the current regulations and ODPC guidance together when classifying the entity. Exemption from registration, where applicable, is not exemption from the substantive data-protection obligations. An organisation still needs to address the lawful handling of the personal data it uses.

Prepare information that matches the real operation

  • Entity and contact details that match the registration records.
  • The activities performed as controller, processor or both.
  • Types of data subjects and personal data handled.
  • Processing purposes and the relevant legal basis.
  • Recipients, service providers and any cross-border arrangements.
  • The organisational and technical safeguards actually in use.
  • Relevant privacy, retention and rights-handling procedures.

Keep the application consistent with the privacy notice, vendor arrangements and operating processes. Copying a generic statement about security can create an inaccurate account of controls that have not been implemented.

Separate official fees from advisory work

ODPC publishes registration categories and fees. Determine the applicable role and entity category before paying, and confirm the current amount through the official portal. Professional assistance with classification, the application or a compliance programme is a separate service.

Ask whether an advisory quote covers registration only, policy work, staff training, processor contracts or an audit. A registration certificate is not an assurance that every processing activity is compliant, and it should not replace an ongoing programme of controls and record-keeping.

Keep the registration connected to compliance

Assign responsibility for maintaining the information and monitoring renewal or change requirements. If the business adds a service, collects a new category of data or changes its vendor model, reassess the mapping rather than waiting for a complaint to reveal the gap.

A first consultation can clarify the roles, registration question and scope of assistance. Prepare an overview of the business and the types of data processed; do not send customer databases or employee files through an enquiry form. For broader gaps, read the companion guide to audit scope and cost.
