Separate three parts of the budget
- Professional fees: the advocate's work under the agreed scope and applicable remuneration framework.
- Taxes on professional services: identified where applicable rather than silently included or omitted.
- Disbursements: official and third-party expenses, with estimates distinguished from confirmed amounts.
A court filing charge, valuation or search payment should not be mistaken for remuneration. Ask what evidence or receipts will be supplied and which expenses need your authority before they are incurred. Check whether a quote is for one stage or the whole expected engagement.
Explain what changes the scope
Urgency, missing records, negotiations, multiple parties, contested issues and changes to the transaction can affect the work. A quotation should identify its assumptions and the process for approving extra work. Ask how a change will be communicated before the original estimate is exceeded.
For example, reviewing an agreed draft is different from rebuilding a contract after the commercial terms change. Similarly, a straightforward succession application can become a contested proceeding. A useful quote makes those boundaries visible instead of promising a fixed outcome regardless of events.
Read a written fee proposal carefully
Check the named client, scope, exclusions, fee basis, taxes, disbursements, payment stages and responsibility for additional instructions. If funds are requested in advance, establish their purpose and how they will be accounted for. Do not pay merely because a calculator displayed a total.
Confirm the firm's payment instructions through an established contact channel, particularly if details appear to change during correspondence. Keep the engagement terms and payment evidence with the matter records so the budget and actual work can be reconciled.
